Terms of Service

1. Acceptance of Terms
By using Dory (our app, website, services, or any related platform), you agree to these Terms of Service. If you don't agree, do not use Dory. We reserve the right to update these terms at any time. Your continued use means you accept the updated terms.
2. Eligibility
- You must be at least 18 years old to use Dory
- You must be a resident of Kodiak, Alaska
- You must provide accurate, truthful information when creating an account
- You are responsible for maintaining the confidentiality of your password
- You are liable for all activity under your account
3. For Customers
Ordering & Payment
- You agree to pay the total amount shown at checkout (food, platform fee, delivery fee, tax)
- All prices include Kodiak sales tax. No additional tax is charged at completion
- Payment is processed by Stripe. You authorize Stripe to charge your payment method
- Failed payments may result in order cancellation
Delivery & Timing
- Estimated delivery times are provided as guidance, not a guarantee
- Delays may occur due to restaurant prep time, traffic, weather, or other factors
- If an order doesn't arrive within a reasonable timeframe, contact support
- Refunds for delays are determined on a case-by-case basis at Dory's discretion
Cancellation & Refunds
- You may cancel within 5 minutes of order placement for a full refund
- Cancellations after prep has started may incur a cancellation fee (at Dory's discretion)
- Driver-initiated cancellations result in a full refund with a new driver assigned
- Refunds are processed to your original payment method within 2-3 business days
Acceptable Use
- Do not attempt to defraud Dory or restaurants (false claims, chargebacks, etc.)
- Do not harass or threaten drivers, restaurants, or Dory staff
- Do not order with intent to violate local laws
- Abusive behavior may result in account termination without refund
4. For Restaurant Partners
Commission & Payouts
- Dory charges 10% commission (early adopters) or 15% (standard) of order subtotal
- You keep 100% of delivery fees paid by customers (these go to drivers, not Dory)
- Daily payouts are processed via Stripe Connect to your bank account
- You are responsible for paying sales tax on your revenue — we don't withhold it
Menu & Pricing
- You control your menu items, descriptions, and pricing
- Prices should be the same on Dory as in-store (no price inflation)
- You may update availability in real-time via the Dory tablet/dashboard
- You're responsible for accurate menu information
Order Fulfillment
- You agree to prepare and fulfill all orders within reasonable timeframes
- If you can't fulfill an order, cancel it immediately via the tablet
- Repeated cancellations or refund requests may result in removal from Dory
- You are responsible for food safety and quality standards
Dory's Relationship to Your Restaurant
- Dory is a delivery platform operator, not a food service operator
- You remain fully responsible for food quality, safety, allergens, and compliance with health regulations
- Dory does not inspect, approve, or endorse the quality of your food
- Customer complaints about food quality, allergies, or dietary issues are between the customer and your restaurant
- Dory is not liable for foodborne illness, allergic reactions, or violations of food safety standards
5. For Drivers
Earnings & Payouts
- You earn $5.99–$10.99 per delivery (varies by zone), plus 100% of customer tips
- Dory guarantees a $8 minimum per completed delivery
- Daily payouts via Stripe Connect to your bank account
- You are responsible for self-employment taxes (Dory provides a 1099-NEC for tax purposes)
Independent Contractor Status
- You are an independent contractor, not an employee of Dory
- You set your own schedule — turn the app on/off whenever you want
- You are responsible for your vehicle maintenance, insurance, and fuel
- You must comply with all traffic laws and local regulations
- You are liable for any accidents, damage, or violations that occur during delivery
Acceptable Behavior
- Deliver orders on time, safely, and without tampering with food
- Treat customers and restaurants with respect
- Do not drive under the influence of drugs or alcohol
- Do not accept tips in the form of drugs, weapons, or illegal goods
- Repeated poor ratings, customer complaints, or unsafe driving may result in deactivation
Dory's Liability
- Dory does not provide health insurance, vehicle insurance, or workers' compensation
- Dory is not responsible for vehicle accidents, traffic tickets, or parking violations
- You must obtain your own commercial vehicle insurance if required by law
- Dory is not liable for injuries, theft, or losses during delivery
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Dory is provided "as-is" and "as-available." We disclaim all warranties, express or implied
- Dory is NOT liable for late deliveries, lost orders, or quality of food
- Dory is NOT liable for driver behavior, accidents, theft, or injuries
- Dory is NOT liable for indirect, incidental, or consequential damages (lost profits, emotional distress, etc.)
- Our total liability is limited to the amount you paid for the order in question
7. Dispute Resolution
First step: If you have a dispute with Dory, contact us directly at contact@dory.delivery with details. We'll work to resolve it.
Escalation: If we can't resolve it via email, you may pursue a claim in small claims court in Kodiak, Alaska.
You agree that any legal proceedings will be governed by Alaska law and take place in Kodiak.
8. User-Generated Content
When you submit ratings, reviews, photos, or feedback on Dory:
- You grant Dory the right to display, reproduce, and distribute your content publicly
- You represent that your content is true, not defamatory, and doesn't infringe anyone's rights
- You are liable for any false, harassing, or illegal content you post
9. Prohibited Activities
You may not use Dory to:
- Commit fraud or misrepresent your identity
- Harass, threaten, or abuse anyone on the platform
- Hack, spam, scrape, or interfere with Dory's systems
- Violate any local, state, or federal law
- Facilitate illegal activities (drugs, weapons, etc.)
- Circumvent payment or commission rules
Violation of these rules may result in immediate account termination, forfeiture of funds, and legal action.
10. Termination
Dory may terminate or suspend your account at any time, with or without cause. Upon termination, your right to use Dory ends immediately. Outstanding earnings will be paid out, but you forfeit any disputed or pending charges.
11. Changes to These Terms
We may update these terms at any time. If material changes are made, we'll notify you via email. Your continued use of Dory means you accept the updated terms.
